DeleteI spoke with an attorney who told me I would be arrested if I tried to take the person who has me restrained to Small Claims Court. From what I have read, that is not true.

Yes; contact, or restraining, orders do not prevent interaction in a court room setting. When you file in small claims court the court alerts the other party of the suit and demands that party to be in attendance the day of the hearing. If you are under a no contact order it would be advisable to (1) arrive at court early, (2) take at least two witnesses along in case the other party attempts a confrontation in the parking lot, (3) keep to yourself and just go to the hearing to present your evidence.
With that said it seems there may be a back and forth here… He/she files for a no contact, you file a small claims suit.
Make no mistake about it; the court WILL recognize this. If it turns out that the no contact order was requested/issued (or that your small claims case is being filed) wrongfully simply because the two of you want to snipe at each other because of some minor argument; the court will reconsider the whole situation. And, you could both potentially end up in jail and/or facing heavy fines for misuse of the courts.
But, if you have a valid claim to take this person to court (small claims or otherwise) proceed to find your justice… Good luck with both those situations…
